You could try Ebay/Amazon or any other online seller, which carry Oblivion. As for the scratched disk issue, the only reason that happens is when players move the console around while the disk is in the console. Even a bit of jittering can dislodge the disk and scratch it up pretty bad, due to the crap effort MS put into securing it while in the console. I feel for you.
